TEMPER — Daily Discipline
By downloading, installing, or using TEMPER ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and BLAUWART INTERNATIONAL (SASU), an independent French company registered under SIREN 940195886 ("we", "us", "our").
TEMPER is a habit tracking application designed to help users build daily discipline through strict accountability. The App tracks habits set by the user and applies a strict accountability mechanic where missed habits turn red permanently at midnight local time.
This mechanic is intentional and core to the App's purpose. By using TEMPER, you acknowledge and accept that:
TEMPER offers an optional Monk Mode feature (Premium) that allows you to commit to a focused discipline period of 15 or 30 days. During an active Monk Mode session, habits cannot be individually locked or unlocked. You may exit Monk Mode at any time, but doing so permanently ends the session with no option to resume it. Monk Mode is a voluntary commitment tool and does not create any obligation beyond the App itself.
TEMPER includes a Progression screen that displays your historical habit performance through anonymized, locally-computed scores based on your habit data. Progression data is derived entirely from information stored on your device and is not transmitted to our servers.
TEMPER offers a free tier that allows you to track up to 3 habits without any payment.
TEMPER offers Premium access through the following subscription options:
Auto-renewable subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription at any time through your iPhone Settings: Settings → your name → Subscriptions → TEMPER → Cancel Subscription. Cancellation takes effect at the end of the current billing period.
If you start a free trial, your trial period begins immediately upon subscribing. You can cancel anytime during the trial period without being charged. If you do not cancel before the end of the trial, your subscription will automatically convert to a paid subscription.
All payments are processed by Apple through your Apple ID. We do not have access to your payment information. Prices may vary by country and are displayed in your local currency at the time of purchase.
All refund requests must be submitted directly to Apple at reportaproblem.apple.com. We do not process refunds directly.
We grant you a limited, non-exclusive, non-transferable, revocable license to use TEMPER on devices that you own or control, in accordance with these Terms and Apple's standard usage rules.
You may not:
You retain full ownership of the habits and data you create within TEMPER. All habit data is stored locally on your device. We do not access, collect, or have any rights over your personal habit data.
Your use of TEMPER is also governed by our Privacy Policy, which explains how we handle data collected through the App.
TEMPER is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
You use TEMPER at your own risk. The App is a tracking tool and is not a substitute for professional medical, psychological, or behavioral advice.
To the maximum extent permitted by applicable law, BLAUWART INTERNATIONAL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TEMPER, including but not limited to loss of data, loss of streaks, or any emotional distress related to the strict accountability mechanic.
Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
We may terminate or suspend your access to TEMPER at any time, without notice, if we believe you have violated these Terms. You may stop using the App at any time by uninstalling it.
Termination of your subscription does not entitle you to a refund for the unused portion of your subscription period.
We may update these Terms from time to time. Material changes will be communicated through the App or by updating the "Last updated" date at the top of this page. Continued use of TEMPER after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.
If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of the country in which you reside.
You acknowledge that these Terms are between you and BLAUWART INTERNATIONAL only, and not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
